Well.....Welcome to the Terms and Conditions page! We don't get a lot of readers on this page. Most people click through without necessarily evaluating what they have agreed to.
We hope you're here for the sake of understanding our respective commitments. In essence, you commit to use the site without intending to submit inappropriate content, break the site, or use it for purposes other than intended. Frintz™ commits to protect your personal information and print the photos you've submitted. We will also use automated tools to evaluate if you have submitted anything inappropriate. If you have, then we reserve the right to delete that photo, and/or your account.
Seems simple enough, but we have lawyers. They told us, "Nothing is that simple. You paid us for real terms and conditions, so you should post them to your site." You promise that, with respect to any User Content you submit on Frintz.com:
- you have the right to submit such User Content, and
- such User Content, or its use by Frintz.com as contemplated by the Agreements, does not violate the Agreements, applicable law, or the intellectual property (including without limitation copyright), publicity, personality, or other rights of others or imply any affiliation with or endorsement of you or your UserContent by Frintz.com or any artist, entity or individual without express written consent from such individual or entity.
Frintz.com may, but has no obligation to, monitor, review, or edit User Content. In all cases, Frintz.com reserves the right to remove or disbale access to any User Content for any or no reason, including but not limited to, User Content that, in Frintz.com's sole discretion, violates the Agreements. Frintz.com may take these actions without prior notification to you or any third party. Removal or disabling of access to User Content shall be at our sole discretion, and we do not promise to remove or disbale access to any specific User Content.
You are soley responsible for all User Content that you submit. Frintz.com is not responsible for User Content. YOU AGREE THAT IF ANYONE BRINGS A CLAIM AGAINS FRINTZ.COM AND DIRECT MAIL 20/20, LLC, RELATED TO USER CONTENT THAT YOU SUBMIT, THEN, TO THE EXTENT PERMISSBALE UNDER LOCAL LAW, YOU WILL INDEMNIFY AND HOLD FRINTZ.COM and DIRECT MAIL 20/20, LLC HARMLESS FROM AND AGAINST ALL DAMAGES, LOSSES, AND EXPENSES OF ANY KIND (INCLUDING REASONABLE ATTORNEY FEES AND COSTS) ARISING OUT OF SUCH CLAIM.
Software License:
The Frintz.com software applications are licensed, not sold, to you, and Frintz.com and its licensors retain ownership of all Frintz.com software applications and Content even after installation on your personal devices.
All Frintz.com trademarks, service marks, trade names, logos, domain names, and other features of the Frintz.com brand are the sole property of Frintz.com or its licensors. The Agreement does not grant you any rights to use any Frintz.com Brand Features whether commercial or non-commercial use.
Third Parties:
The Frintz.com service is integrated with third part applications, websites, and services ("Third Party Applications") to make available content and services to you. These Third Party Applications may have their own terms and conditions of use and privacy policies and your use of these Third Party Applications will be governed by and subject to such terms and conditions and privacy policies. You understand and agree that Frintz.com does not endorse and is not responsible or liable for the behavior, features, or content of any 3rd-Party Application.
Service Limitation:
Frintz.com will make reasonable efforts to keep the Frintz.com service operational. However, certain technical difficulties or maintenance may result in interruptions. Frintz.com reserves the right at any time to modify, discontinue, temporarily or permanently, functions and features of the Frintz.com service, with or without notice, all without liability to you.
